Definations
This has been the subject of different definitions by different writers.
PHIBSON ON EVIDENCE stated that, evidence means "the testimony whether oral, documentary or oral, which may be legally received in order to prove or disprove some facts in dispute"

CROSS stated that evidence is "the testimomy. hearsay, documents, things and facts which a court will accept as evidence of fact in issue in a given case.
Abdullahi Z Aliyu mantafien stated that evidence may be defined as all legal means exclusive of mere aguement which tends to prove or disprove any matter of fact in the court of law.
WORKING DEFINITION: Evidence is the means by which fact in issue are established by a judicial tribunal.such evidence could be oral testimony of a person who actually perceived the facts, i.e. through any one of the senses,or documentary evidence which is the production of documents to prove facts which are in isue, or real evidence which is the production of material objects other than documents. in sumary, the law of evidence deals with the use of evidence to establish or prove fact on which Claims, charges and defences of litigants are based before a judicial are based before a judicial tribunal.
WHAT IS THE USE OF EVIDENCE IN LEGAL PRACTICE? A legal practitioner would lose his case without his being able to do in evidence.
Everything a lawyer needs to do in th law court hinges upon the law of evidence.
This is because evidence cuts across all facts relating to legal practice whether criminal or civil.


It is often said that a judge cannot penetrate human mind. He can only go by the evidence adduced before him by the lawyer. The basic questions a lawyer must ask himsef are these:
1. What am i supposed to do?
2. How am I supposed to go about doing such?

Advocacy is the bedrock of legal practice. Hence, a lawyer should be very articulate and skillful in the act of advocacy. In every given case, a lawyer should lay proper and adequate foundation before presenting his evidence in court.
SCOPE OF LAW EVIDENCEIn relation to legal procedings, there are two broad divisions of law namely subtantive or abjectival or adjective law.
(a) Substantive law: this defines rights, duties and liabilities of parties to a transaction in issue. Substantive law is a generic term embracing such subject as the law of torts, contract and crimes. It is also concerned with statements of rights, duties and liabilities are grounded.
(b) Adjectival or adjective law: this governs the machinery by which substantive law is applied in practice. it regulates the conduct of litigation and it is concerned with establishing the facts upon which rights duties and liabilities are founded in essence adjectival laws provide the platform upon which duties and liabilities are grounded Adjectival law therefore comprises of procedure and evidence the term procedure is often used to embrace evidence espcially in proceedings where evidence is required.

RULES OF EVIDENCEThe rules of evidence are said to have evolved or have been formulated to assist in the determination of four principal problems:
1. Upon whom rests the burden of proving facts? the answer to the question is not a clear-cut one. for example AZ is accused by LBC of stealing his shirt. the burden of proof rests on LBC. Again, AZ is accused of murder, and he pleads insanity as a defence this is a unique case as the burden of proof would rest on a since he is in best position to prove his insanity this is against the background of the presumption of sanity as regarding every man that is seen on the street.
2. What facts may be proved? generally, party must prove every material that upon which he intends to rely by adducing sufficient evidence for example LBC is accused of stealing AZ car the prosecution must establish by adducing sufficient evidence that LBC fraudulently took AZ car or that LBC fraudulently converted same to his own use or to the use of another person. But, there are exceptions to these rules especially in cases of facts of which the courts may take judicial notice or in cases of civil proceedings where there are formal admissions of fact made before the pleadings.
3. What facts ought to be excluded from court's cognizance? Not all facts relating to a case ozr a matter may be presented before the courts. Generally, proofs of facts in issue and of facts relevant to facts in issue are admissible. for example, the fact that LBC was seen driving AZ car is relevant to the fact in issue which is the theft of the car. the point that not all facts relating to a case is presented to the law court, is responsible for the general rule tha parties to an action are not generally allow to give evidence of their reputation, painting them to be of good character.
4. What modes of proof are acceptable? As a general rule, the Nigerian legal system recognises particular kinds of proof only. For example, proof by oral evidence, proof by real evidence, proof by electronic gadgets, proof by documdntary evidence, and in modern times. However, their are exceptions to these wide general rules.


Question
What should a cousel do when his client in a criminal case admits to him in chamber that he indeed committed the offence charged?
(a) Advise him to raise a preliminary objection upon arrangement
(b) Seriously consider declining the brief
(c) Advise him pleade not guilty and allow the prosecution prove its case
(d) Advise him to plead guilty giving insanity as excuse

10 Things To Do Before Ramadan.

Dear Brothers and sisters in islam,All Praise is to Allaah who has brought us to this moment, Rajab. There's no doubt, Ramadan is fast knocking on our doors, thus, we beseech Allaah(SWT) to preserve us in faith and health till then, ameen.
I know you are aware of what Ramadan comes with; its virtues and opportunities. Hence, I admonish you and myself on the following:
1. Repay your missed fasts, don't be in the league of those seeking fatwa when others are seeking the new moon.
2.Try and perfect your recitations; will you be missing the great rewards of reciting the Quran in this year's Ramadan because of the difficulty you encounter in recitation? There's time, go and meet your Imam, Mallam, Alfa.. rectify those "crackings". May Allaah make it easy.
3.Go for a medical check up and treat your ailments, may Allaah heal you. You may repay fast if missed but what's better than fasting Ramadan in the blessed month itself?
4.Go and do muraja(revision); yes! you've memorized 1,2,3...30 juz from the Quran. Will you be holding mushaf to perform qiyamulayl??
5.Get used to tahajud..... Long one, don't be in the first 3 taraweeh league.
6. Start saving up: if feeding yourself and your family may be difficult, you still have time to put things together and 'hussle'too.
7. Learn more about Ramadan: Yes, there will be many seatings of knowledge in Ramadan but you need to attend before it. Plus, ask questions about unclear or unknown rulings. You can't afford to waste your effort. May Allaah accept it.
8. Don't be a glutton: you know you can't do without eating an hour. Ramadan is at your door, be disciplined!
9. AVOID ALCOHOL : it's a sin yesterday, today and tomorrow, not only in Ramadan. It's the mother of sins and renders your 40 days solah useless. Imagine! Someone sips a cup of alcohol on 21st of sha'ban.... Alcohol ingestion is evil.. Avoid it!!!!!!!!

The virtue of fasting:
Firstly: clear verses from the book of Allah which incite the Muslim to fast, in order to draw closer to Allah and which explain the virtue of it:
Allah subnawo wataalah said:
أَيَّامًا مَّعۡدُودَٲتٍ ۚ فَمَن كَانَ مِنكُم مَّرِيضًا أَوۡ عَلَىٰ سَفَرٍ فَعِدَّةٌ مِّنۡ أَيَّامٍ أُخَرَ ۚ وَعَلَى ٱلَّذِينَ يُطِيقُونَهُ ۥ فِدۡيَةٌ طَعَامُ مِسۡكِينٍ‌ ۖ فَمَن تَطَوَّعَ خَيۡرًا فَهُوَ خَيۡرٌ لَّهُ ۥ ۚ وَأَن تَصُومُواْ خَيۡرٌ لَّڪُمۡ‌ ۖ إِن كُنتُمۡ تَعۡلَمُونَ (Fast) a certain number of days; and (for) him who is sick among you, or on a journey, (the same) number of other days; and for those who can afford it there is a ransom: the feeding of a man in need - but whoso doeth good of his own accord, it is better for him: and that ye fast is better for you if ye did but know -Q-2:184
Because of the goodness which is inherent to fasting in these circumstances, it is clear to us that it contains the basis elements required for controlling one's desire, and a preference for workshopping Allah while being at ease. all of these elements are required in Islamic training. Likewise, it is clear to us that fasting holds a number of healthful advantages except for the invalid even if the fasting person experiences some strain due to it.
Allah suhanawo wataallah said:
إِنَّ ٱلۡمُسۡلِمِينَ وَٱلۡمُسۡلِمَـٰتِ وَٱلۡمُؤۡمِنِينَ وَٱلۡمُؤۡمِنَـٰتِ وَٱلۡقَـٰنِتِينَ وَٱلۡقَـٰنِتَـٰتِ وَٱلصَّـٰدِقِينَ وَٱلصَّـٰدِقَـٰتِ وَٱلصَّـٰبِرِينَ وَٱلصَّـٰبِرَٲتِ وَٱلۡخَـٰشِعِينَ وَٱلۡخَـٰشِعَـٰتِ وَٱلۡمُتَصَدِّقِينَ وَٱلۡمُتَصَدِّقَـٰتِ وَٱلصَّـٰٓٮِٕمِينَ وَٱلصَّـٰٓٮِٕمَـٰتِ وَٱلۡحَـٰفِظِينَ فُرُوجَهُمۡ وَٱلۡحَـٰفِظَـٰتِ وَٱلذَّٲڪِرِينَ ٱللَّهَ كَثِيرًا وَٱلذَّٲڪِرَٲتِ أَعَدَّ ٱللَّهُ لَهُم مَّغۡفِرَةً وَأَجۡرًا عَظِيمًا Lo! men who surrender unto Allah, and women who surrender, and men who believe and women who believe, and men who obey and women who obey, and men who speak the truth and women who speak the truth, and men who persevere (in righteousness) and women who persevere, and men who are humble and women who are humble, and men who give alms and women who give alms, and men who fast and women who fast, and men who guard their modesty and women who guard (their modesty), and men who remember Allah much and women who remember - Allah hath prepared for them forgiveness and a vast reward.Q-33:35
Secondly: the clear varses from the book of AllahWhich spreak of fasting as an atonement for things such as shaving the head while in a state of ihram, when one is permitted to do so, due to illness or some harm to the head, because of this inability to provide a sacrificial animal, killing a person by mistake who is protected by a treaty, breaking one's oath, killing game while in while in a state of ihram and ziharah.
Allay subhawo wataala said:
وَأَتِمُّواْ ٱلۡحَجَّ وَٱلۡعُمۡرَةَ لِلَّهِ ۚ فَإِنۡ أُحۡصِرۡتُمۡ فَمَا ٱسۡتَيۡسَرَ مِنَ ٱلۡهَدۡىِ‌ ۖ وَلَا تَحۡلِقُواْ رُءُوسَكُمۡ حَتَّىٰ يَبۡلُغَ ٱلۡهَدۡىُ مَحِلَّهُ ۥ ۚ فَمَن كَانَ مِنكُم مَّرِيضًا أَوۡ بِهِۦۤ أَذًى مِّن رَّأۡسِهِۦ فَفِدۡيَةٌ مِّن صِيَامٍ أَوۡ صَدَقَةٍ أَوۡ نُسُكٍ ۚ فَإِذَآ أَمِنتُمۡ فَمَن تَمَتَّعَ بِٱلۡعُمۡرَةِ إِلَى ٱلۡحَجِّ فَمَا ٱسۡتَيۡسَرَ مِنَ ٱلۡهَدۡىِ ۚ فَمَن لَّمۡ يَجِدۡ فَصِيَامُ ثَلَـٰثَةِ أَيَّامٍ فِى ٱلۡحَجِّ وَسَبۡعَةٍ إِذَا رَجَعۡتُمۡ ۗ تِلۡكَ عَشَرَةٌ كَامِلَةٌ ۗ ذَٲلِكَ لِمَن لَّمۡ يَكُنۡ أَهۡلُهُ ۥ حَاضِرِى ٱلۡمَسۡجِدِ ٱلۡحَرَامِ ۚ وَٱتَّقُواْ ٱللَّهَ وَٱعۡلَمُوٓاْ أَنَّ ٱللَّهَ شَدِيدُ ٱلۡعِقَابِ Perform the pilgrimage and the visit (to Makka) for Allah. And if ye are prevented, then send such gifts as can be obtained with ease, and shave not your heads until the gifts have reached their destination. And whoever among you is sick or hath an ailment of the head must pay a ransom of fasting or almsgiving or offering. And if ye are in safety, then whosoever contenteth himself with the visit for the pilgrimage (shall give) such gifts as can be had with ease. And whosoever cannot find (such gifts), then a fast of three days while on the pilgrimage, and of seven when ye have returned; that is, ten in all. That is for him whoso folk are not present at the Inviolable Place of Worship. Observe your duty to Allah, and know that Allah is severe in punishment.Q-2:196
And also Allah the most high said:
وَمَا كَانَ لِمُؤۡمِنٍ أَن يَقۡتُلَ مُؤۡمِنًا إِلَّا خَطَـًٔا ۚ وَمَن قَتَلَ مُؤۡمِنًا خَطَـًٔا فَتَحۡرِيرُ رَقَبَةٍ مُّؤۡمِنَةٍ وَدِيَةٌ مُّسَلَّمَةٌ إِلَىٰٓ أَهۡلِهِۦۤ إِلَّآ أَن يَصَّدَّقُواْ ۚ فَإِن كَانَ مِن قَوۡمٍ عَدُوٍّ لَّكُمۡ وَهُوَ مُؤۡمِنٌ فَتَحۡرِيرُ رَقَبَةٍ مُّؤۡمِنَةٍ‌ ۖ وَإِن ڪَانَ مِن قَوۡمِۭ بَيۡنَڪُمۡ وَبَيۡنَهُم مِّيثَـٰقٌ فَدِيَةٌ مُّسَلَّمَةٌ إِلَىٰٓ أَهۡلِهِۦ وَتَحۡرِيرُ رَقَبَةٍ مُّؤۡمِنَةٍ‌ ۖ فَمَن لَّمۡ يَجِدۡ فَصِيَامُ شَهۡرَيۡنِ مُتَتَابِعَيۡنِ تَوۡبَةً مِّنَ ٱللَّهِ ۗ وَكَانَ ٱللَّهُ عَلِيمًا حَڪِيمًا It is not for a believer to kill a believer unless (it be) by mistake. He who hath killed a believer by mistake must set free a believing slave, and pay the blood-money to the family of the slain, unless they remit it as a charity. If he (the victim) be of a people hostile unto you, and he is a believer, then (the penance is) to set free a believing slave. And if he cometh of a folk between whom and you there is a covenant, then the blood-money must be paid unto his folk and (also) a believing slave must be set free. And whoso hath not the wherewithal must fast two consecutive months. A penance from Allah. Allah is Knower, Wise. Q-4:92.
And he, the most high said:
لَا يُؤَاخِذُكُمُ ٱللَّهُ بِٱللَّغۡوِ فِىٓ أَيۡمَـٰنِكُمۡ وَلَـٰكِن يُؤَاخِذُڪُم بِمَا عَقَّدتُّمُ ٱلۡأَيۡمَـٰنَ‌ ۖ فَكَفَّـٰرَتُهُ ۥۤ إِطۡعَامُ عَشَرَةِ مَسَـٰكِينَ مِنۡ أَوۡسَطِ مَا تُطۡعِمُونَ أَهۡلِيكُمۡ أَوۡ كِسۡوَتُهُمۡ أَوۡ تَحۡرِيرُ رَقَبَةٍ‌ ۖ فَمَن لَّمۡ يَجِدۡ فَصِيَامُ ثَلَـٰثَةِ أَيَّامٍ ۚ ذَٲلِكَ كَفَّـٰرَةُ أَيۡمَـٰنِكُمۡ إِذَا حَلَفۡتُمۡ ۚ وَٱحۡفَظُوٓاْ أَيۡمَـٰنَكُمۡ ۚ كَذَٲلِكَ يُبَيِّنُ ٱللَّهُ لَكُمۡ ءَايَـٰتِهِۦ لَعَلَّكُمۡ تَشۡكُرُونَ Allah will not take you to task for that which is unintentional in your oaths, but He will take you to task for the oaths which ye swear in earnest. The expiation thereof is the feeding of ten of the needy with the average of that wherewith ye feed your own folk, or the clothing of them, or the liberation of a slave, and for him who findeth not (the wherewithal to do so) then a three days' fast. This is the expiation of your oaths when ye have sworn; and keep your oaths. Thus Allah expoundeth unto you His revelations in order that ye may give thanks.Q-5:89
And he the must high said:
يَـٰٓأَيُّہَا ٱلَّذِينَ ءَامَنُواْ لَا تَقۡتُلُواْ ٱلصَّيۡدَ وَأَنتُمۡ حُرُمٌ ۚ وَمَن قَتَلَهُ ۥ مِنكُم مُّتَعَمِّدًا فَجَزَآءٌ مِّثۡلُ مَا قَتَلَ مِنَ ٱلنَّعَمِ يَحۡكُمُ بِهِۦ ذَوَا عَدۡلٍ مِّنكُمۡ هَدۡيَۢا بَـٰلِغَ ٱلۡكَعۡبَةِ أَوۡ كَفَّـٰرَةٌ طَعَامُ مَسَـٰكِينَ أَوۡ عَدۡلُ ذَٲلِكَ صِيَامًا لِّيَذُوقَ وَبَالَ أَمۡرِهِۦ ۗ عَفَا ٱللَّهُ عَمَّا سَلَفَ ۚ وَمَنۡ عَادَ فَيَنتَقِمُ ٱللَّهُ مِنۡهُ ۗ وَٱللَّهُ عَزِيزٌ ذُو ٱنتِقَامٍ O ye who believe! Kill no wild game while ye are on the pilgrimage. Whoso of you killeth it of set purpose he shall pay its forfeit in the equivalent of that which he hath killed, of domestic animals, the judge to be two men among you known for justice, (the forfeit) to be brought as an offering to the Ka'bah; or, for expiation, he shall feed poor persons, or the equivalent thereof in fasting, that he may taste the evil consequences of his deed. Allah forgiveth whatever (of this kind) may have happened in the past, but whoso relapseth, Allah will take retribution from him. Allah is Mighty, Able to Requite (the wrong).Q-5:95
And he must high says:
ٱلَّذِينَ يُظَـٰهِرُونَ مِنكُم مِّن نِّسَآٮِٕهِم مَّا هُنَّ أُمَّهَـٰتِهِمۡ‌ ۖ إِنۡ أُمَّهَـٰتُهُمۡ إِلَّا ٱلَّـٰٓـِٔى وَلَدۡنَهُمۡ ۚ وَإِنَّہُمۡ لَيَقُولُونَ مُنڪَرًا مِّنَ ٱلۡقَوۡلِ وَزُورًا ۚ وَإِنَّ ٱللَّهَ لَعَفُوٌّ غَفُورٌ Such of you as put away your wives (by saying they are as their mothers) - They are not their mothers; none are their mothers except those who gave them birth - they indeed utter an ill word and a lie. And lo! Allah is Forgiving, Merciful.
Thirdly: fasting and the Qur'an will intercede for the one who fasts and recites the Qur'an
It is reported on the authority of 'Abdullah ibn 'Amr ibn Al-As may Allah be please with him that the messenger of Allah may peace and blessing of Allah be upon him said:
"Fasting and Qur'an intercede for the slave on the day of judgment, saying: 'O, Lord! I prevented him from food and from desires during the day, so make me an intercessor for him.' And the Qur'an will say: ' I prevented him sleeping at night, so make me an intercessor for him. ' He may Allah peace be upon him added: "Then Allah will grant grant them intercession."
This is an authentic hadith. May Allah {S.W.A}bless us and grant us deep understanding of the Religion Ameen.

The obligation to fast during the month of Ramadan
1. The linguist meaning of sawm Is to totally abstain from something, as in the following peotic verses:
" Horses which hold back and horses which do not hold back Beneath the dust( of battle), which others are chomping at the bit."
This was said by An-Nabighah Az-Zubyani in his 'Deewan'(112).
( Translators note: His real name was Ziyad ibn mu'awiyah a poet)
The juristic meaning of sawm:Refraining from eating, drinking and sexual intercourse, along with the intention to do so, from dawn until sunset.
Some Qur'anic commentator have said that two kinds of sawn are mentioning in Qur'an:
The first is the juristic type of sawm which is known as in the words of Allah the most high said:
يَـٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُواْ كُتِبَ عَلَيۡڪُمُ ٱلصِّيَامُ كَمَا كُتِبَ عَلَى ٱلَّذِينَ مِن قَبۡلِڪُمۡ لَعَلَّكُمۡ تَتَّقُونَ O ye who believe! Fasting is prescribed for you, even as it was prescribed for those before you, that ye may ward off (evil);Q-2:183
also in another verse Allah the most high said:
شَہۡرُ رَمَضَانَ ٱلَّذِىٓ أُنزِلَ فِيهِ ٱلۡقُرۡءَانُ هُدًى لِّلنَّاسِ وَبَيِّنَـٰتٍ مِّنَ ٱلۡهُدَىٰ وَٱلۡفُرۡقَانِ ۚ فَمَن شَہِدَ مِنكُمُ ٱلشَّہۡرَ فَلۡيَصُمۡهُ‌ ۖ وَمَن ڪَانَ مَرِيضًا أَوۡ عَلَىٰ سَفَرٍ فَعِدَّةٌ مِّنۡ أَيَّامٍ أُخَرَ ۗ يُرِيدُ ٱللَّهُ بِڪُمُ ٱلۡيُسۡرَ وَلَا يُرِيدُ بِڪُمُ ٱلۡعُسۡرَ وَلِتُڪۡمِلُواْ ٱلۡعِدَّةَ وَلِتُڪَبِّرُواْ ٱللَّهَ عَلَىٰ مَا هَدَٮٰكُمۡ وَلَعَلَّڪُمۡ تَشۡكُرُونَ The month of Ramadan in which was revealed the Qur'an, a guidance for mankind, and clear proofs of the guidance, and the Criterion (of right and wrong). And whosoever of you is present, let him fast the month, and whosoever of you is sick or on a journey, (let him fast the same) number of other days. Allah desireth for you ease; He desireth not hardship for you; and (He desireth) that ye should complete the period, and that ye should magnify Allah for having guided you, and that peradventure ye may be thankful. Q-2:185
The second is silence as in the words of Allah, the most high:
فَكُلِى وَٱشۡرَبِى وَقَرِّى عَيۡنًا‌ ۖ فَإِمَّا تَرَيِنَّ مِنَ ٱلۡبَشَرِ أَحَدًا فَقُولِىٓ إِنِّى نَذَرۡتُ لِلرَّحۡمَـٰنِ صَوۡمًا فَلَنۡ أُڪَلِّمَ ٱلۡيَوۡمَ إِنسِيًّا So eat and drink and be consoled. And if thou meetest any mortal, say: Lo! I have vowed a fast unto the Beneficent, and may not speak this day to any mortal. Q-19:26
there is nothing disliked in a person saying"
ramadhan has come and ramadhan has gone ,"according to the majority Muslim scholars, based upon the hadith of Abu hurairah may Allah be pleased with him Who reported that the messager Of Allah may peace be upon him said.
When the month of ramadhan come,the gates of paradise are opened,the gates of hell are closed and the devils are chained up"
Narrated by Al-bukahri in (no.1899) and Muslim (no.1079).
This is an authentic hadith. It is also because saying that something is dislike must be substantiated by a legal prohibition of it and there is no such confirmation in the Islamic law. As for the hadith Abu hurairah may Allah be pleased with him in which it is stated that he said: " the messenger of Allah may peace be upon him said:
"Do not say: " Ramadan ", because Ramadan is one of the names of Allah; instead, say: the month of Ramadan." It is a week hadith.
Narrated by Al-Baihaqi in as-sunan Al-kubra(4/201).
the ruling of fasting:Fasting in Ramadan is one of the pillars of Islam.
Allah, the most high says in surah Al- Baqarah (2:183):
يَـٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُواْ كُتِبَ عَلَيۡڪُمُ ٱلصِّيَامُ كَمَا كُتِبَ عَلَى ٱلَّذِينَ مِن قَبۡلِڪُمۡ لَعَلَّكُمۡ تَتَّقُونَ O ye who believe! Fasting is prescribed for you, even as it was prescribed for those before you, that ye may ward off (evil);
It is reported on the authority of Abdullah ibn umar may Allah be please with him, from the prophet Muhammad may peace be upon him said:
Islam is founded on five principles, I.e. belief in Allah and his messenger, the five compulsory prayers, fasting the month of Ramadan, the payment of Zakat and the hajj."
This is an authentic hadith.
Narrated by all-bukhari(no.8) and Muslim(no.18).
